Terms of Service
Last updated: October 12, 2026
1. Who we are
The SiteSmith service is operated by Rosseta Systems sp. z o.o., ul. Zwycięstwa 2, 42-700 Lubliniec, Poland, registered in the Polish National Court Register (KRS) under number 0000482365, NIP (tax ID) 5761576472 ("we", "us"). Contact: [email protected]. By purchasing through SiteSmith you ("you", "the buyer") agree to these Terms.
2. What the service is
SiteSmith sells rebuilt static websites. We create a rebuilt version of a business's existing website or public profile and publish a live preview. You can inspect the complete preview — every page, on any device — before deciding to buy. The purchase is a one-time payment for the website shown in that preview: its files, hosting at its sitessmith.com address (section 10), the customer panel (section 11) and reasonable changes (section 6). There is no monthly or yearly fee for the website.
3. What you receive
- A ZIP archive containing the complete website: HTML, CSS and JavaScript files and all image assets, exactly as shown in the preview at the time of purchase;
- A written setup guide (
setup-guide.html) covering hosting, editing images, enabling visitor tracking, and how the contact form works; - A perpetual, non-exclusive license to use, modify, and host the delivered files for the business the website describes (section 8);
- Hosting of the website at its sitessmith.com address, with HTTPS, with no monthly or yearly fee (section 10), and the customer panel (section 11).
Unless bought as the optional add-on in section 11, you do not receive a domain name or email services, nor any service not listed above.
4. Purchase, delivery, refunds
Payment is processed by Stripe. After payment you are redirected to a download page; the download link remains available and can be reused if the download is interrupted.
All sales are final once the files have been downloaded. Because the complete website is available for inspection as a live preview before purchase, and because the product is digital goods delivered instantly, no refunds are provided after download. If a technical fault on our side prevents you from downloading at all, contact us and we will deliver the files by other means or refund the payment.
30-day money-back guarantee. Every website bought on or after October 12, 2026 comes with a money-back guarantee, shown on its checkout page (and so does a website bought earlier for which we offered one in writing): you may ask for a full refund of the website price within 30 days of buying it, by replying to any of our emails or writing to the contact address above, provided the website's files have not been downloaded (from the download link or from the customer panel). We refund to the original payment method. When we refund, the hosting at the sitessmith.com address and the customer panel for that website end, and so does the license in section 8. The guarantee covers the website price only: domain registrations, transfers, connections and their renewals (section 11) are not refundable, and a domain registered for you stays yours. One guarantee per business.
5. No warranty — files are provided "as is"
The website files are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, accuracy of content, or uninterrupted error-free operation. You inspected the preview before buying; what you saw is what you get.
6. Changes and support
Reasonable changes to the website we built — wording, photos, opening hours, lists, colors — that you request through the customer panel or by email are included in the price, before and after purchase, and are made on a best-effort basis. We may decline requests that go beyond that website (for example new functionality such as booking engines, payments or logins) and will tell you so. Help is included too: you can ask about the website, its hosting, the domain add-on and your mailbox through the Help tab of the customer panel or by email, including help moving your domain and help putting the website's files on hosting of your own, and we answer on a best-effort basis; we do not offer phone support. Beyond this, the purchase price does not include other technical support (for example for the hosting account you use elsewhere once the files are there, your own devices or third-party services), maintenance or updates, and we have no obligation to provide them; help we give voluntarily does not create a right to future support.
7. Your responsibilities
- Content review: the rebuilt website was created from your existing public website. You are responsible for reviewing all texts, prices, offers, and contact details for accuracy before publishing, and for the legal compliance of your business content (including privacy and consumer law applicable to you).
- Hosting elsewhere: we host the website at its sitessmith.com address as described in section 10. If you choose to host the files somewhere else, hosting them there is your responsibility; the guide explains free options, and we help you put the files there if you ask.
- Your materials: we build the website from your own materials — the texts, photos, logos, reviews and other content published on your current website or sent to us by you. They are your responsibility. By buying, you confirm that you have the rights and permissions to publish them, including the consent of anyone who can be recognized in your photos (for a child, a parent's or guardian's). We do not check rights or consents in your materials and make no warranty about them. If something should not be shown, tell us and we remove it from your website at no charge.
8. License and ownership
Upon full payment you receive a perpetual, worldwide, non-exclusive license to use, modify, publish, and create derivative works of the delivered files for the business the website describes. Your own business content (texts, photos, trademarks) remains yours. We retain the right to use the general design techniques, code patterns, and know-how to create works for others, and to reference non-confidential aspects of the work in our portfolio.
9. Contact form service
Delivered websites may include a contact form connected to our form-forwarding service (spam filtering and delivery of messages to your email). This service is provided free of charge, on a best-effort basis, as a courtesy: it carries no availability guarantee and may be modified or discontinued at any time. The setup guide explains how to reconnect the form to a provider of your choice at any time.
10. Preview; included hosting
Before purchase, the live preview is temporary: it is provided to let you evaluate the work, may be modified while you review it, and is withdrawn after the period stated in our emails if you do not buy.
Included hosting. After purchase we keep your website hosted at its sitessmith.com subdomain, with HTTPS, free of charge — no monthly or yearly fee — for as long as you keep hosting switched on in your customer panel. Hosting is provided on a best-effort basis, without an availability guarantee or SLA, and may be migrated to other infrastructure. Should we ever discontinue it, we will tell you at your contact email at least 30 days in advance. It does not include a custom domain (section 11). Your permanent entitlement remains the downloaded files, which you can host anywhere at any time.
11. Optional add-on: your own domain and mailbox
Where offered at checkout or in the customer panel, you may buy a yearly add-on under which we (a) register a domain name of your choosing from the names we propose, in your name, through our accredited registrar OVHcloud, acting as your agent on the authorisation you give at checkout, or transfer a domain name you already hold to OVHcloud, keeping you as its registrant; (b) point the domain at your hosted website; and (c) provide one or more email mailboxes on that domain through OVHcloud's mail service.
- You are the registrant. Your name and contact details are sent to the domain registry and may appear in public WHOIS/RDDS records. The registrar's own terms and ICANN's registrant rights and responsibilities apply to the registration.
- Renewal. The add-on is a yearly subscription: after the first year it renews automatically on each anniversary at the renewal price shown at purchase, charged to the payment card you provided. We email you about a month before each renewal. You can cancel at any time before the renewal date from the customer panel (Manage renewal), in which case the add-on runs to the end of the paid term and then lapses; no refunds are given for a term already charged. If a renewal payment fails and is not resolved, we stop renewing and the domain lapses at the end of its term.
- Transfers in. To bring a domain you already hold, you unlock it at your current provider and give us its transfer code. The registry and your current provider decide whether and when the transfer completes (usually within five days); it adds a year to the domain's term. Before the transfer we copy the domain's existing DNS records so that what you run on it — email above all — keeps working. Those services stay with the providers that host them today, under your account there and at your cost.
- Leaving. You may transfer the domain to another provider at any time; we unlock it and send the transfer code to your email address free of charge, subject to the registry's transfer lock on newly registered domains.
- A domain you keep where it is. Instead of registering or transferring, you may keep a domain you already hold with its current registrar and DNS provider and point it at your hosted website by setting the DNS records we give you. It stays registered to you there, under your account and at your cost, and renews there; we have no access to it. For such a domain the add-on covers serving your website on it with HTTPS, the contact form on it and our help, and a transfer to OVHcloud or a mailbox remains available on request within the same subscription. If you change those records, or the domain lapses, the website stops showing on it and stays online at its sitessmith.com address. When the subscription ends, we stop serving the website on that domain at the end of the paid term.
- Email. Mailboxes are provided on a best-effort basis. Mail passing through them is your data; we act as a processor for it and access it only to operate the service (see the Privacy Policy). Keep your password safe and change it after first sign-in.
- DNS. The panel lets you edit DNS records. Records that keep the website and email working are protected; changes you make to other records are your responsibility.
Customer panel. The panel at panel.sitessmith.com (sign-in by one-time code to the email address you paid with) lets you download your files, edit the site's text, lists and photos, request changes, and manage the domain add-on. It is provided free of charge on a best-effort basis and may be modified with reasonable notice.
12. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or related to the service and the delivered files is limited to the amount you paid. We are not liable for indirect, incidental, or consequential damages, lost profits, or lost data. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer rights that may apply in your jurisdiction.
13. Governing law
These Terms are governed by the laws of Poland. Disputes will be resolved by the court competent for the seat of Rosseta Systems sp. z o.o., unless mandatory consumer law provides otherwise.
14. Changes
We may update these Terms; the version published at the time of your purchase applies to that purchase.
15. Optional preview text notifications
The SiteSmith text messaging service is operated by Michał Malik, sole proprietor. For messaging support, contact [email protected].
For website requests submitted through our form, regardless of how you found SiteSmith, we email the completed preview, may send one short personal note after you first open it, and send up to three reminders: normally a few days later, about a week later, and a last one shortly before the preview is taken down, 30 days after we sent it. If you start checkout but do not finish, we may send one note about it. Reminders go out in the morning in your time zone, never more than one a day. Replying postpones the next reminder until a few quiet days after your latest message; unsubscribing, purchasing the site or withdrawing the preview stops them. Our follow-ups and replies are written with the help of AI and checked against our rules; anything they cannot answer goes to a person.
By checking the optional SMS box, you agree to receive automated SiteSmith text messages at the number you provide: a link to your requested website preview and up to three reminders, normally after 3, 8 and 16 days. Up to four messages per request. Message and data rates may apply. Consent is not a condition of a rebuild or purchase. We send during 9am–6pm in the time zone reported automatically by your browser; delays may occur. Delivery is not guaranteed and carriers are not liable for delayed or undelivered messages.
Reply STOP to opt out or HELP for help. Other replies stop reminders and are passed to our support team, who can answer by email. Purchasing the site or withdrawing the preview stops remaining reminders. For help contact [email protected]. See our SMS privacy information.
16. Referrals
A customer can share a personal referral link, shown in their customer panel (sitessmith.com/?ref=…). A business that asks for its preview through that link is quoted $20 less for its website than our price at that time, and keeps that price for that preview. When that business pays for its website, we send the customer whose link it used a $25 gift card by email, normally within 30 days — one per referred business. A link does not lower the price of websites you order yourself, and we may refuse a reward for referrals that are not genuine (for example your own businesses, or a link posted on coupon sites). If you share your link publicly, say that you receive a reward when someone buys. We may change or end the program at any time; a price already quoted and a gift card already earned are kept.
17. Featuring your website
Only with your permission, given on a page that shows exactly what would be published, we may show your website on sitessmith.com and in a post on SiteSmith’s Facebook page: screenshots of it, your business name, its type and city, a link to it, and any words you add (published exactly as you write them, with your first name if you give it). Being featured is optional, unpaid and separate from referral rewards. You can withdraw at any time — from your customer panel, with the link to the page where you agreed, or by replying to any of our emails. We then remove your website from sitessmith.com at once and delete the Facebook post; shares or screenshots other people made are outside our control.
18. Keeping a copy of your website
We keep copies of your website's files — each version we deliver, together with the edits you make in your customer panel — so that we can help you with it later, including when you host the site yourself. We keep them for as long as you are our customer. Ask us and we delete them, apart from what accounting law requires us to keep. The files you downloaded remain yours either way.
